APPEALS OF FEDERAL CRIMNAL PROSECUTIONS

After several federal courts ruled that state bingo laws were regulatory laws that could not be enforced against Native American tribes, Congress began looking at legislation that would satisfy the interests of law enforcement agencies and that would help to alleviate the economic problems of the Native American tribes by raising revenue through bingo and gaming. As a result, Congress enacted the Indian Gaming Regulatory Act (IGRA) of 1988.

Attorney-Client Privilege

Communications between an attorney and a client made during a professional meeting are considered confidential and do not have to be disclosed. The client owns this communication and therefore the client is the only individual who may waive this privilege. The purpose of this privilege is so that the client may be able to fully disclose all information to his or her attorney.

Bail or Jail

After a defendant is arrested, he or she is required to appear before a judge or magistrate. At this time, the defendant may request or a judge may set bail for the defendant's release. Bail is cash or a cash equivalent that is given to the court to ensure that he or she will appear in court when ordered. If the defendant appears when he or she was ordered to, bail is refunded. However, if he or she fails to appear, the court keeps the bail and issues a warrant for his or her arrest.

Hybrid Representation and the Standby Attorney

Hybrid representation is where the defendant serves as co-counsel with an attorney. The defendant does not have a constitutional right to hybrid representation. It is within the trial court's discretion to grant the defendant's request for hybrid representation.

Lie Detector Tests and Polygraphs

A lie detector test or a polygraph test is used to determine whether the defendant or witness shows physiological and psychological reactions in response to certain questions. These tests are typically given if it is believed that the defendant or a witness is intentionally trying to deceive authorities or attorneys. There are various types of lie detector tests.
